Please read these terms and conditions carefully before using the website

1. Introduction

  1. 1.1 These Cashback Terms govern the use of Nice Pak Products cash back offers (Cashback) and constitute a binding legal agreement between NICE PAK PRODUCTS PTY LTD (ACN 051 956 346, ABN 71 051 956 346) of 120 Woodlands Drive, Braeside, VIC, 3195, Australia (Nice Pak Products, we or us) and the person redeeming, attempting to redeem or otherwise in possession of a Cashback (you). These Terms are to be read in conjunction with our website Terms and Conditions and our other terms or policies available on our website from time to time at nicepak.com.au.
  2. 1.2 We require that you read these Cashback Terms carefully before redeeming or attempting to redeem a Cashback. By redeeming or attempting to redeem a Cashback, you agree to be bound by these Cashback Terms.

2. Cashback Offer

  1. Nice Pak Products provides a Cashback to customers who purchase both the E45 Face Foaming Cleanser and E45 Face Moisturiser (Participating Products) from Australian retailers. For the avoidance of doubt, the Cashback is only available to customers who purchase both Participating Products and purchase of a single product will deem the customer ineligible to redeem the Cashback.

3. Promotion Period

  1. You may redeem the Cashback between 1st November 2023 and 31st January 2024.

4. Amount

  1. The Cashback amount is $10 AUD.

5. Redemption

  1. 5.1 You may redeem your Cashback by completing the form located at www.e45.com/auz/ and uploading a valid receipt which clearly evidences all details relating to purchase of a Participating Product (Transaction), including:
    1. a) store name;
    2. b) date of purchase;
    3. c) products purchased, including the Participating Products;
    4. d) price of each item; and
    5. e) total amount spent
    6. (Valid Receipt).
  2. 5.2 You accept and acknowledge that it is your responsibility to produce a Valid Receipt in order to redeem the Cashback. If your receipt was unclear, faded or damaged upon its provision to you at purchase, you acknowledge that it is your responsibility to request a reprinted receipt from the applicable retailer. Nice Pak Products is not liable for any failure by a retailer to print a clear or readable receipt.
  3. 5.3 Nice Pak Products may determine the validity of a receipt in its sole discretion. For the avoidance of doubt, we reserve the right to reject a receipt and your redemption of the Cashback for any reason, including without limitation, where the Receipt is unreadable, crumpled or faded.

6. Bank deposit

  1. The Cashback will be deposited directly into your nominated bank account within 60 days. You acknowledge and agree the Cashback will not be nominated if the bank account details provided are incorrect, invalid or for a bank account outside of Australia.

7. Eligibility and validity

  1. The Cashback is only redeemable:
    1. a) by Australian citizens;
    2. b) within the Promotion Period;
    3. c) once per Transaction; and
    4. d) by the first 250 successful applicants in Australia or while stocks last (Offer Pool).
  2. For the avoidance of doubt, customers who apply for the Cashback after the Offer Pool has been exhausted will not receive a Cashback.

8. Privacy

  1. Our Privacy Policy applies to our collection of your personal information in relation to Cashbacks. You can access our Privacy Policy here: https://www.nicepak.com.au/legal/privacy-policy

9. Severability

  1. Any provision of these Cashback Terms that is prohibited or unenforceable in any jurisdiction is to be severed from the Cashback Terms in that jurisdiction to the extent of the prohibition or unenforceability.

10. Governing Law

  1. These Cashback Terms are governed by the laws of Victoria, Australia and each party submits to the exclusive jurisdiction of courts of Victoria there in relation to these Cashback Terms.

11. Amendments

    1. 11.1 Nice Pak Products reserves the right to amend these Cashback Terms from time to time in its sole discretion.
    2. 11.2 The latest version of the Cashback Terms as amended from time to time is published at https://www.nicepak.com.au/legal/terms-conditions. It is your responsibility to keep up to date with these Cashback Terms.
    3. 11.3 Any amendments to these Cashback Terms will apply to all Cashbacks redeemed after the amendment date.
